Privacy Notice
Falling Pickaxe (package name rocks.fallingpickaxe.mine) is distributed through Google Play under the developer account of CrushGames INC, referred to in this notice as "we", "us" or "the developer". We are the party responsible for the app and for anything this notice says about personal information. Questions, requests and complaints can be sent at any time to [email protected]; replies are written in English.
This notice applies to the Falling Pickaxe app for Android, in every version distributed through Google Play, and to any email you choose to send us about it. It does not apply to Google Play itself, to your device's operating system, or to any other app or website, each of which is governed by its own terms. It takes effect on the date shown above and replaces any earlier text about the same app.
Falling Pickaxe is an offline game. It creates no account, never requests personal details such as what you are called or how you can be reached, uses no advertising or analytics services, and is not granted network access of any kind. The only information it keeps is your game progress, stored on your own device. We, the developer, never receive that progress and cannot see it.
To be specific, the app does not collect, record, transmit or sell any of the following categories of information:
(a) Identifiers: no phone number, real name, user name or email address, and no account ID, advertising ID, Android ID or device serial number.
(b) Contacts and communications: no access to your contacts, call log, messages or calendar.
(c) Location: no precise or approximate location, whether from GPS, Wi-Fi or the mobile network.
(d) Device and technical information: no IP address, device model, operating system version, crash reports or diagnostic logs are sent anywhere.
(e) Usage information: no record of which screens you open, how long you play, what you tap or how you perform ever leaves the phone.
(f) Financial information: the game has no purchases, so no payment card, bank or billing details are ever requested.
(g) Sensitive information: no health, biometric, camera, microphone, photo or file data is accessed.
Because none of this information is collected, none of it is shared with, rented to or sold to any third party.
To let you continue where you stopped, the app writes a single save file to the private storage area that Android reserves for it. The file holds game data only: your play-coin balance, rank and experience points, the picks you have unlocked, trophy and contract progress, expedition stars, the time of your last supply cart, your sound, ambience and vibration settings, and the state of a Drop that was still in progress when the app closed. It contains nothing that identifies you.
Other apps cannot read this file, and the app keeps it out of cloud backups by opting out of Android's automatic backup. The file remains in place while the app is installed. You can delete it at any time by opening Settings, then Apps, then Falling Pickaxe, and wiping its storage there, or by uninstalling the app; either action removes your progress permanently, and we have no copy from which it could be restored.
The app requests a single permission:
VIBRATE, which lets the phone give a short buzz when a TNT keg goes off, when the pick melts in magma or when you bank a large haul. Vibration has its own on/off switch in the Lamp Room.
Internet access, storage, location, camera, microphone, contacts and notifications are not among the permissions it asks for. Should a future version ever need a new permission, this notice will be revised ahead of the release that introduces it.
The app is downloaded and updated through Google Play, a service operated by Google LLC. When you install or update the app, Google handles information under the terms of the Google Privacy Policy (https://policies.google.com/privacy), and we have no control over that processing. Google may share with us aggregated, non-identifying statistics through the Play Console, such as the number of installs per country or the number of reported crashes; these figures do not let us identify any individual player.
The app contains no third-party software development kits for advertising, analytics, attribution, crash reporting, social login or cloud storage. Its game engine (Solar2D) works only on the phone itself and reports nothing to its authors.
To the extent that data protection law applies to the limited processing described here, the grounds are as follows. Keeping your save file on your device is necessary to provide the game you asked to use (Article 6(1)(b) of the EU and UK General Data Protection Regulation). Reading and answering a message you write to us rests on our legitimate interest in handling enquiries about our app (Article 6(1)(f)). We do not rely on consent for any processing, because nothing beyond this is carried out.
Since the app itself transmits no personal information, no international transfer takes place through it. If you email us, your message is delivered through the email provider used for the contact address above, which may store it on servers outside your country; we do not move it anywhere else.
The save file is protected by Android's application sandbox, which prevents other apps from reading it. Because no personal information leaves your device through the app, there is no server-side database of players that could be breached. Emails are kept in a password-protected mailbox that only the developer can open.
Correspondence is kept only while it helps to resolve your request, and in any case no longer than twelve months after the matter is closed, unless a longer period is required to comply with a legal obligation.
The rights below apply according to the law of the place where you live. Because the app holds your progress only on your device, most of them can be exercised directly on that device; for anything else, write to [email protected] and we will respond within one month, or sooner where your local law requires it.
European Economic Area and United Kingdom (GDPR and UK GDPR): you may request a copy of personal information about you, ask that it be fixed or deleted, limit or object to its processing, and receive it in a portable format. In practice, the only information we could hold about you is an email you sent us.
California (CCPA as amended by the CPRA): you have the right to know what personal information is collected, to delete it, to correct it, and to opt out of its sale or sharing. We do not sell personal information and do not share it for cross-context behavioral advertising, and we have not done so in the preceding twelve months. We will not treat you differently for exercising any of these rights.
Brazil (LGPD): you may confirm whether processing takes place, obtain access, correction, anonymization or deletion, request information about sharing, and revoke consent where consent is the basis.
Canada (PIPEDA): you may request access to personal information held about you and challenge its accuracy and completeness.
Players elsewhere enjoy the rights granted by their own local legislation, and we will honour those requests in the same way.
Falling Pickaxe contains simulated gambling with play coins and is intended only for people of 18 or older. The app asks players to confirm their age on first launch. Nobody under 18 is the intended player, and we do not knowingly collect personal information from anyone under 18, or under 13 within the meaning of the US Children's Online Privacy Protection Act (COPPA). If you believe a minor has emailed us personal information, contact us and we will delete it.
The app shows no web pages and uses no cookies, local web storage, pixels or similar tracking technologies. Since no tracking takes place, Do Not Track signals and similar browser or operating system preferences are respected by default.
If you contact us by email, we receive your email address, whatever you write and anything you attach. We use this information only to read and answer your message and to keep a record of how the request was handled. It is not added to any mailing list, not used for marketing and not passed to anyone else, except where the law obliges us to disclose it.
If the app or the law changes and this notice has to follow, a revised version will be published at the address above and the date shown in the heading will change. A material change, such as a new permission or any new collection of data, will also be mentioned in the "What's new" notes of the app version that introduces it. Earlier versions remain available on request.
This notice is governed by the laws of the jurisdiction in which CrushGames INC is established, without depriving you of any protection granted by the mandatory consumer and data protection laws of the country where you live. If you are unhappy with how we have handled a request, please tell us first so that we can try to put it right. You may also lodge a complaint with a supervisory authority: in the European Economic Area, the data protection authority of your member state; in the United Kingdom, the Information Commissioner's Office; in Brazil, the Autoridade Nacional de Proteção de Dados; in Canada, the Office of the Privacy Commissioner of Canada; and in California, the California Privacy Protection Agency.
